NBA BRANCHES ELECTION GUIDELINES 2016
The National Executive Committee of the NBA, at its meeting held in Jos on February 18, 2016 constituted the NBA BRANCHES ELECTION MONITORING GROUP. NEC empowered the Committee among other things to monitor, supervise and direct the election of elected officers of Branches of the NBA. In the exercise of its powers, the Committee hereby issues the following Guidelines.
1. That the offices for which members or candidates will be eligible to contest for elective offices in the Branches under the Uniform Bye-laws and their qualifications are as appear hereunder: –
(a) Chairman: ten (10) years post call
(b) Vice-Chairman: ten (10) years post call
(c) Secretary: eight (8) years post call
(d) Assistant Secretary: five (5) years post call
(e) Treasurer: eight (8) years post call
(f) Financial Secretary: eight (8) years post call
(g) Social Secretary: eight (8) years post call
(h) Publicity Secretary: eight (8) years post call
(i) Welfare Secretary: eight (8) years post call
(j) Legal Adviser: eight (8) years post call
(k) Provost: eight (8) years post call
(l) National Executive Committee Representative: be one of the two preceding past Chairmen and Vice-Chairmen,
2. ELIGIBILITY TO CONTEST: To be eligible to stand for election into an office, a member must:
(1) Be validly nominated in writing by two members who are eligible to vote herein and who must themselves be qualified for the particular office as provided for in these By-Laws;
(2) Have attended a minimum of five (5) monthly meetings of the Branch within the twelve (12) months prior to the close of nominations for the election;
(3) Be a financial member of the Branch and shall have paid his/ her bar practicing fees and annual branch dues as and when due for at least the three (3) years preceding the election or since enrolment, and must be in legal practice.
(4). Be nominated or proposed in writing by a member and seconded by another both of whom shall be qualified like the candidate in accordance with the provisions of the Uniform Bye-laws for the equivalent office and in good standing with their practising fees and all other Branch levies
3. DISQUALIFICATION FROM CONTESTING:
(1) No member of the Branch shall be eligible to contest for an office to which he/she has been elected and occupied before.
(2) Any member who has held elective offices as a Branch officer for two (2) terms shall not be eligible to contest for a Branch office until at least five (5) years after his/her last term of office. It is immaterial whether he/she resigned, was removed and or did not complete a two year term in any of the offices.
(3) Any contestant or whose supporters publishes, prints or distributes any campaign material, gifts and any form of souvenir whatsoever shall shall be disqualified from being voted for.
4. ELIGIBILITY TO VOTE: To be eligible to vote a member of a branch:
(1) shall be a financial member of the Branch and shall have paid his/her bar practicing fees and annual branch dues, as and when due, for the two (2) years preceding the election or since enrolment, if less than two (2) years post-call,
(2) shall have attended a minimum of five (5) monthly general meetings of the Branch within the twelve (12) months preceding the date of the election.
5. DUTIES OF THE ELECTION COMMITTEE
(1) Not later than the (10) days to the day of the election year, the Election Committee shall announce the date of the election as fixed by the Executive Committee and invite nominations for candidates for office;
(2) Shall publicise the provisions of this Guidelineswith regards to eligibility to contest and eligibility to vote in Branch elections.
(3) Scrutinise all nominations to ensure that they comply with the provisions herein and shall notify candidates who fail to qualify of their disqualification within seven (7) days of any decision to such effect; provided that such a disqualified candidate may apply to the Committee for a review of the decision within seven (7) days;
(4) Where there is no qualified candidate to fill an office, the Election Committee shall fix a date for a By-election in respect of that office and shall call for fresh nominations thereto.
6. PROCEDURE AT ELECTION
(1) Voting at elections shall be either by electronic voting or physical voting by secret ballot, as may be determined by the Election Committee.
(2) Where electronic voting method is adopted, the Election Committee shall engage the services of competent and credible service providers to provide the electronic voting platform and shall conduct the elections in a transparent and fair manner in accordance with clear published guidelines.
(3) Where physical voting by secret ballot method is adopted, the Election Committee shall engage such security and other adjunct personnel as may be necessary to ensure a transparent, free, fair and orderly conduct of the elections in accordance with clear published guidelines.
(4) Votes at elections shall be counted immediately after the close of voting and the result shall be declared immediately by the Chairman of the Election Committee.
7. SWEARING-IN OF NEWLY ELECTED OFFICERS/ ASSUMPTION OF OFFICE AND HANDING OVER
Following the declaration of the results, the newly elected officers shall be sworn-in at the Annual General Meeting immediately following the elections by the administration of the Oath of Office contained in the Second Schedule to the Uniform Byelaws on them by a serving Judge or Notary-Public.
8. No Branch Electoral Committee shall issue any guideline inconsistent with this guideline. All Branch Committees shall adopt the guideline and adopt same for use in the conduct of their respective Branch elections.
